NATIONAL SLAVERY AND HUMAN TRAFFICKING PREVENTION MONTH, 2017

 

Dear Washington State Legislators;

 

January 11, 2017 observed National Slavery and Human Trafficking Prevention day.  In 2014, President Barack Obama, Proclaimed January as National Slavery and Human Trafficking Prevention Month.

I would like to take a moment to ask you to consider the very real similarities between Slavery and Human Trafficking as it relates to Paternity Fraud.

Paternity Fraud, or Mis-attributed Paternity occurs when a woman identifies the wrong man as the father of her child, which results in an innocent man being court ordered to pay child support for a non-genetic child. Regardless of how paternity is established (Presumed through marriage, Default Adjudication or Paternity Acknowledgment), it is evident to all, that the woman always maintains knowledge of whom her sexual partner(s) was at the time of conception, and to withhold the vital knowledge of other possible genetic fathers while obtaining a man’s signature on a Paternity Acknowledgment form, or testifying in court under oath that a man is the only possible father, is the same as Fraud.

“Silence can only be equated with fraud where there is a legal and moral duty to speak, or where an inquiry left unanswered would be intentionally misleading…” U.S. v. Tweel, 550 F.2d 297, 299. See also U.S. v. Prudden, 424 F.2d 1021,1032; Carmine v. Bowen, 64 A. 932

Several victims of Paternity Fraud have come forward to testify in support of Legislative Reform over the last three years. Their many varying tales of how they became victims, all tell the same tale.

A woman had conceived a child, withheld knowledge of other possible fathers and established paternity with the wrong man. These women obtained paternity through deception and have taken or Kidnapped children from biological fathers without their knowledge and have violated the child’s right to know their true parentage, in order to obtain support orders that financially benefit the woman.

It is time that society stop punishing these victims with phrases like “Best Interest of The Child”, which is loosely construed to support these crimes under the premise of “Financial Support”.

Our Children deserve more than financial support. Our Children are our most precious treasure. Our Future… and they have a right to know their real fathers, regardless of financial support.

Our Fathers deserve more than to be equal to a “Pay Check”. Our Fathers deserve to have meaningful relationships with their true biological children and deserve to have the financial ability to care for those children without the forced financial slavery to a criminal.

Society does not claim that Women don’t get to be mothers if they cannot pay for their child. Instead society lifts them up and honors them through social programs designed specifically to help single mothers, so why would Legislators believe these false ideologies that Kidnapping of innocent children and Involuntary Servitude of an innocent Man, are “In the Best Interest of the Child”?

This January 2017 marks the awareness month for Slavery and Human Trafficking, as well as the beginning to the 4th Washington State Legislative Session in a row that Legislation has been introduced that would finally Stop Paternity Fraud.

I ask you to please support the passage of this paramount reform.

I am asking the House Judiciary Committee to give HB 1306 a Public Hearing as soon as possible, and that this bill be supported equally by Democrats and Republicans.

RCW 9A.60.030 states:  A person is guilty of obtaining a signature by deception or duress if by deception or duress and with intent to defraud or deprive he or she causes another person to sign or execute a written instrument.

Perjury RCW 9A.72.020 defines Perjury in the first degree as a person is guilty of perjury in the first degree if in any official proceedings, he or she makes a materially false statement which he or she knows to be false under an oath required or authorized by law. Perjury in the first degree is a class C felony.

RCW 9A.72.080 “Statement of what one does not know to be true” states “Every unqualified statement of that which one does not know to be true is equivalent to a statement of that which he or she knows to be false”.

RCW 9a.40.100 defines Trafficking as: (1) A person is guilty of trafficking in the first degree when: (a) Such person: (i) Recruits, harbors, transports, transfers, provides, obtains, buys, purchases, or receives by any means another person knowing, or in reckless disregard of the fact, (A) that force, fraud, or coercion as defined in RCW 9A.36.070 will be used to cause the person to engage in: (II) Involuntary servitude; (Innocent Men forced to Pay Child Support for non-genetic Children is Involuntary Servitude)or (ii) Benefits financially or by receiving anything of value from participation in a venture that has engaged in acts set forth in (a)(i) of this subsection; and (b) The acts or venture set forth in (a) of this subsection:

(i) Involve committing or attempting to commit kidnapping; (Withholding a child from the Biological Father without knowledge or permission is Kidnapping)

Involuntary servitude or involuntary slavery is a United States legal and constitutional term for a person laboring against that person’s will to benefit another, under some form of coercion other than the worker’s financial needs. Court Ordered Child Support Payments to a Mother who has committed fraud in obtaining a Paternity Establishment is Involuntary servitude to the Mother and to the Court system that would penalize the innocent man for non-payment.

Over a century and a half after President Abraham Lincoln issued the Emancipation Proclamation, millions remain in bondage — children forced to take part in armed conflict or sold to brothels by their destitute families, men and women who toil for little or no pay, who are threatened and beaten if they try to escape. Slavery tears at our social fabric, fuels violence and organized crime, and debases our common humanity. During National Slavery and Human Trafficking Prevention Month, we renew our commitment to ending this scourge in all its forms.

Because modern-day slavery is a global tragedy, combating it requires international action. The United States is shining a spotlight on the dark corners where it persists, placing sanctions on some of the worst abusers, giving countries incentives to meet their responsibilities, and partnering with groups that help trafficking victims escape from their abusers’ grip. We are working with other nations as they step up their own efforts, and we are seeing more countries pass anti-human trafficking laws and improve enforcement.

At home, we are leading by example. My Administration is cracking down on traffickers, charging a record number of perpetrators. We are deploying new technology in the fight against human trafficking, developing the Federal Government’s first-ever strategic action plan to strengthen victim services, and strengthening protections against human trafficking in Federal contracts. During the past year, the White House has hosted events on combating human trafficking, bringing together leaders from every sector of society. Together, we came up with new ideas to fight trafficking at the national and grassroots levels.

As we work to dismantle trafficking networks and help survivors rebuild their lives, we must also address the underlying forces that push so many into bondage. We must develop economies that create legitimate jobs, build a global sense of justice that says no child should ever be exploited, and empower our daughters and sons with the same chances to pursue their dreams. This month, I call on every nation, every community, and every individual to fight human trafficking wherever it exists. Let us declare as one that slavery has no place in our world, and let us finally restore to all people the most basic rights of freedom, dignity, and justice.

NOW, THEREFORE, I, BARACK OBAMA, President of the United States of America, by virtue of the authority vested in me by the Constitution and the laws of the United States, do hereby proclaim January 2014 as National Slavery and Human Trafficking Prevention Month, culminating in the annual celebration of National Freedom Day on February 1. I call upon businesses, national and community organizations, faith-based groups, families, and all Americans to recognize the vital role we can play in ending all forms of slavery and to observe this month with appropriate programs and activities.
