NCFM files reply brief in National Coalition for Men et al. v. Selective Service System

On May 8, 2025, we filed our reply brief in the case of National Coalition for Men et al. v. Selective Service System, now before the United States Court of Appeals for the Ninth Circuit (see PDF below). We are confident that the salient issues favor our position and are comprehensively presented in our appeal. Oral arguments are not expected.

Meanwhile, Wendy Murphy, a legal advisor for Equal Means Equal, recently filed a similar lawsuit, arguing that the exclusion of women from Selective Service registration violates both the Equal Rights Amendment and the Fifth Amendment’s Equal Protection Clause. Murphy discussed her self-proclaimed landmark case in a recent RealClearPolitics interview.

During the interview, Murphy referenced the pending 2023 case of Valame v. Biden, yet conspicuously failed to acknowledge our organization by name—even as she addressed cases filed by men’s rights organizations. She went further, claiming that these cases seek to “make women sign up for the draft but don’t give them full equality… and keep them subjugated.”

Let us be unequivocally clear: at no point, in any of our legal filings or public statements, have we ever advanced such an assertion. Murphy’s defamatory mischaracterization is wholly unfounded—though regrettably, not unprecedented.

This is not the first time Murphy has recklessly distorted facts. During the 2006 Duke Lacrosse rape scandal, despite the total absence of evidence, she made sensational and inflammatory accusations against the falsely accused players while zealously defending the prosecution, including District Attorney Mike Nifong, who was ultimately disbarred for gross misconduct.

Murphy’s repeated willingness to misrepresent the truth in pursuit of her ideological agenda raises serious credibility concerns about her legal arguments and public statements.

Regardless, perhaps Murphy’s recent filing, Valame, and our cases will be one or the other or all together successful. Perhaps the cases should be combined, which may be in the best interest of all of us.

    Awesome news! We are so winning this thanks you the awesome Nadine Lewis. On the other hand I listened to the interview with Wendy Murphy and what she said is scandalous and wrong! “Make women register but don’t give them full equality”? For somone who purports to be all about the facts I would like to ask her where exactly she read that in our lawsuit(s).
