In my decades as a military lawyer, federal prosecutor, and state prosecutor, I haven’t seen anything as illuminating as what Dr. Eric Nelson, Ph.D., M.S., M.A., M.A., reveals in his podcast series, “Just The Facts With Dr. Nelson.” In several two minute podcasts Dr. Nelson plays excerpts from videos used to train judges. You will see judicial trainers tell judges:
- It is OK to issue a “Domestic Violence” restraining order (DVRO) even when DV isn’t alleged.
- Be careful not issuing a DVRO, because the probability of being overturned by the court of appeal is very high.
- They know many of the accusations in DVRO requests are false–as high as 50%.
- They know many DVRO’s are sought not from fear or need, but rather because they are a powerful tool women can use to fight their ex-husband or father of their children in divorce and custody proceedings.
Let’s think about due process for a minute. This is the practice of making sure that someone who is accused of something is given a fair chance to (1) Present evidence and witnesses, (2)  Cross-examine his accuser(s), (3) To make important arguments before the court, and (4) To be given fair consideration and just treatment by the judge. Where is due process when DVRO’s can be issued in the absence of domestic violence? Where is due process when a judge issues a DVRO simply because he is required to issue it or face sanctions?
